(وَيَتَّجِهُ) (وَكَذَا) يَحْرُمُ نَبْشُ مَيِّتٍ (ذِمِّيٍّ) دُفِنَ (بِ) أَرْضٍ مُنْفَكَّةٍ عَنْ الِاخْتِصَاصَاتِ (غَيْرِ) أَرْضِ (الْحَرَمِ) ، فَلَا يُنْبَشُ مَعَ بَقَاءِ رِمَّتِهِ، (لِأَنَّهُ مُحْتَرَمٌ) ،

وَأَمَّا إذَا دُفِنَ بِالْحَرَمِ فَيُنْبَشُ، وَهُوَ مُتَّجِهٌ.
