وَإِنْ كَانَ مِنْ ترِكَةٍ وَفِي مُسْتَحِقِّهَا مَحْجُورٌ عَلَيهِ حَرُمَ فِعْلُهُ وَأَكلٌ مِنْهُ.

مطالب أولي النهىal-Ruhaybani

(وَإِنْ كَانَ) طَعَامُهُمْ (مِنْ التَّرِكَةِ وَفِي مُسْتَحِقِّيهَا) ، أَيْ: التَّرِكَةِ (مَحْجُورٌ عَلَيْهِ) أَوْ مَنْ لَمْ يَأْذَنْ؛ (حَرُمَ فِعْلُهُ) ، أَيْ: الطَّعَامِ، (وَ) حَرُمَ (أَكْلٌ مِنْهُ) ، لِأَنَّهُ مَالُ مَحْجُورٍ عَلَيْهِ، أَوْ مَالُ الْغَيْرِ بِغَيْرِ إذْنِهِ.
