وَلَوْ لَمْ يُوصِ بِهَا كَالْعَشْرِ، وَلِحَدِيثِ:«فَدِينُ اللَّهِ أَحَقُّ بِالْقَضَاءِ» ، وَلِأَنَّهَا حَقٌّ وَاجِبٌ تَصِحُّ الْوَصِيَّةُ بِهِ أَشْبَهَ دَيْنَ الْآدَمِيِّ.
