(وَيَتَّجِهُ: وَمَعَ جَهْلِ) وَرَثَةٍ (بِإِخْرَاجِ) مُوَرِّثٍ (فَاسِقٍ) الزَّكَاةَ فِي حَيَاتِهِ (فَالْأَصْلُ عَدَمُ) ، أَيْ: الْإِخْرَاجِ، فَيُخْرِجُهَا وَارِثٌ مِنْ تَرِكَتِهِ. (وَفِي) جَهْلِ وَرَثَتِهِ بِإِخْرَاجِ مُوَرِّثٍ (عَدْلٍ يُحْتَمَلُ) الْإِخْرَاجُ وَعَدَمُهُ، وَحَيْثُ احْتَمَلَ فَالِاحْتِيَاطُ الْإِخْرَاجُ تَبْرِئَةً لِذِمَّةِ الْمَيِّتِ، وَهُوَ مُتَّجِهٌ
