وَلَا يَلزَمُ دَفْعُها لَهُ إذا طَلَبها، وَلَيسَ لَهُ إخبَارُ مُمتَنِع إذَنْ.

مطالب أولي النهىal-Ruhaybani

(وَلَيْسَ لَهُ) ، أَيْ: الْإِمَامِ (إجْبَارُ مُمْتَنِعٍ إذَنْ) ، أَيْ: حَيْثُ لَمْ يَمْنَعْ مَنْ هِيَ عَلَيْهِ إخْرَاجَهَا بِالْكُلِّيَّةِ، إذْ الْوَاجِبُ الْإِخْرَاجُ، لَا الدَّفْعُ إلَى الْإِمَامِ.

[فَصْلٌ يُشْتَرَطُ لِإِخْرَاجِ الزَّكَاةِ نِيَّةٌ] (فَصْلٌ)
