وَيَجْتَمِعُ جَزَاءٌ وَضَمانٌ فِي مَمْلُوكٍ،

(وَيَجْتَمِعُ) عَلَى مُتْلِفِ صَيْدٍ (ضَمَانُ) قِيمَته لِمَالِكِهِ (وَجَزَاؤُهُ) لِمَسَاكِينِ الْحَرَمِ (فِي) صَيْدِ (مَمْلُوكٍ) ، لِأَنَّهُ حَيَوَانٌ مَضْمُونٌ بِالْكَفَّارَةِ، فَجَازَ التَّقْوِيمُ وَالتَّكْفِيرُ فِي ضَمَانِهِ، كَالْعَبْدِ إذَا قُتِلَ.
