(وَيَتَّجِهُ) : إنَّمَا يَضْمَنُ مَنْ نَفَّرَ صَيْدًا (مَعَ قَصْدِ تَنْفِيرِهِ) ،

أَمَّا إذَا نَفَّرَ الصَّيْدَ فَزَعًا مِنْ شَخْصٍ مَرَّ قَرِيبًا مِنْهُ، أَوْ أَرَادَ ضَرْبَ دَابَّتِهِ وَنَحْوِهَا، فَنَفَّرَ فَتَلِفَ؛ فَلَا ضَمَانَ عَلَيْهِ، لِأَنَّهُ لَمْ يَقْصِدْ تَنْفِيرَهُ، وَهُوَ مُتَّجِهٌ.
