(فَإِنْ آثَرَ) الَّذِي بِيَدِهِ أَرْضٌ خَرَاجِيَّةٌ (بِهَا أَحَدًا صَارَ الثَّانِي أَحَقَّ بِهَا) مِنْ غَيْرِهِ، لِقِيَامِهِ مَقَامَ الْأَوَّلِ، (كَمَا يَأْتِي فِي) بَابِ إحْيَاءِ (الْمَوَاتِ) مُفَصَّلًا.
