وَمَنْ عَجَزَ عَن عِمَارَةِ أَرْضِهِ أُجبِرَ عَلَى إجَارَتِهَا، أَوْ رَفْعِ يَدِهِ عَنهَا، لِتُدفَعَ لِمَنْ يَعمُرُهَا وَيَقُومُ بِخَرَاجِهَا،

مطالب أولي النهىal-Ruhaybani

(وَمَنْ عَجَزَ عَنْ عِمَارَةِ أَرْضِهِ) الْخَرَاجِيَّةِ (أُجْبِرَ عَلَى إجَارَتِهَا) لِمَنْ يَعْمُرُهَا، (أَوْ) عَلَى (رَفْعِ يَدِهِ عَنْهَا لِتُدْفَعَ لِمَنْ يَعْمُرُهَا وَيَقُومُ بِخَرَاجِهَا) ، لِأَنَّ الْأَرْضَ لِلْمُسْلِمِينَ فَلَا يُعَطِّلُهَا عَلَيْهِمْ.
