(وَلَيْسَ لِأَحَدٍ تَفْرِقَةُ خَرَاجٍ عَلَيْهِ بِنَفْسِهِ) ، لِأَنَّ مَصْرِفَهُ غَيْرُ مُعَيَّنٍ (وَمَصْرِفُهُ) ، أَيْ: الْخَرَاجُ (كَفَيْءٍ) ، لِأَنَّهُ مِنْهُ، فَيَفْتَقِرُ إلَى اجْتِهَادِ الْإِمَامِ، لِأَنَّهُ لِلْمَصَالِحِ كُلِّهَا.
