(وَبَيْتُ الْمَالِ مِلْكٌ لِلْمُسْلِمِينَ) ، لِأَنَّهُ لِمَصَالِحِهِمْ (يَضْمَنُهُ مُتْلِفُهُ) كَغَيْرِهِ مِنْ الْمُتْلَفَاتِ، (وَيَحْرُمُ أَخْذٌ مِنْهُ بِلَا إذْنِ إمَامٍ) ، لِأَنَّهُ افْتِئَاتٌ عَلَيْهِ فِيمَا هُوَ مُفَوَّضٌ إلَيْهِ.
