(وَمَنْ مَاتَ بَعْدَ حُلُولِ الْعَطَاءِ دَفَعَ لِوَرَثَتِهِ حَقَّهُ) ، لِأَنَّهُ مَاتَ بَعْدَ الِاسْتِحْقَاقِ، فَانْتَقَلَ حَقُّهُ إلَى وَرَثَتِهِ كَسَائِرِ الْحُقُوقِ،

قَالَ فِي " شَرْحِ الْإِقْنَاعِ ": وَقِيَاسُهُ جِهَاتُ الْأَوْقَافِ إذَا مَاتَ بَعْدَ مُضِيِّ زَمَنِ اسْتِحْقَاقِهِ يُعْطَى لِوَرَثَتِهِ.
