(وَتَجِبُ) الْجِزْيَةُ (عَلَى مُعْتَقٍ وَلَوْ لِمُسْلِمٍ) ، لِأَنَّهُ حُرٌّ مُكَلَّفٌ مِنْ أَهْلِ الْقَتْلِ، فَلَمْ يُقَرَّ بِدَارِنَا بِلَا جِزْيَةٍ كَحُرٍّ أَصْلِيٍّ، (وَ) تَجِبُ عَلَى (مُبَعَّضٍ بِحِسَابِهِ) بِقَدْرِ حُرِّيَّتِهِ كَالْإِرْثِ.
