وَمَنْ مَرِضَ لَمْ يَخْرُجْ حَتَّى يَبْرَأَ وَمن مَاتَ دُفِنَ بِهِ.

مطالب أولي النهىal-Ruhaybani

(وَمَنْ مَرِضَ) مِنْ كُفَّارٍ بِالْحِجَازِ (لَمْ يَخْرُجْ) مِنْهُ (حَتَّى يَبْرَأَ) ، لِمَشَقَّةِ الِانْتِقَالِ عَلَى الْمَرِيضِ، فَتَجُوزُ إقَامَتُهُ، (وَ) مَنْ يُمَرِّضُهُ.

وَ (إنْ مَاتَ) كَافِرٌ بِالْحِجَازِ (دُفِنَ بِهِ) ، لِأَنَّهُ أَوْلَى بِالْجَوَازِ مِنْ إقَامَتِهِ لِلْمَرَضِ.
