(أَوْ قَاتَلَنَا مُنْفَرِدًا، أَوْ مَعَ أَهْلِ حَرْبٍ) ، لِأَنَّ إطْلَاقَ الْأَمَانِ يَقْتَضِي عَدَمَ الْقِتَالِ، (أَوْ لَحِقَ بِدَارِ حَرْبٍ مُقِيمًا) لَا لِتِجَارَةٍ وَنَحْوِهَا، لِصَيْرُورَتِهِ مِنْ جُمْلَةِ أَهْلِ الْحَرْبِ،
