(وَكَذَا هِبَةٌ وَهَدِيَّةٌ وَصَدَقَةٌ) ؛ فَتَنْعَقِدُ بِالْمُعَاطَاةِ؛ لِاسْتِوَاءِ الْجَمِيعِ فِي الْمَعْنَى، وَلَمْ يُنْقَلْ عَنْهُ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - وَلَا عَنْ أَصْحَابِهِ، اسْتِعْمَالُ إيجَابٍ وَقَبُولٍ فِي شَيْءٍ مِنْ ذَلِكَ.
