مطالب أولي النهىal-Ruhaybani

(وَيَتَّجِهُ هَذَا) أَيْ: تَحْرِيمُ أَخْذِ الزِّيَادَةِ عَلَى ثَمَنِ الْمِثْلِ (إنْ لَزِمَتْ) بِإِلْزَامِ السُّلْطَانِ (الْمُعَاوَضَةُ بِثَمَنِ الْمِثْلِ) ، وَإِلَّا فَلَا يَحْرُمُ عَلَيْهِ أَخْذُ زِيَادَةٍ لَا تُجْحِفُ؛ لِعُمُومِ قَوْلِهِ:«إنَّمَا الْبَيْعُ عَنْ تَرَاضٍ» . وَهُوَ مُتَّجِهٌ.
