(وَعَلَيْهِ إنْ وُلِدَ حَيًّا قِيمَتُهُ) ؛ لِأَنَّهُ فَوَّتَهُ عَلَى مَالِكِهِ بِاعْتِقَادِهِ الْحُرِّيَّةَ (يَوْمَ وُضِعَ) ؛ لِأَنَّهُ أَوَّلُ إمْكَانِ تَقْوِيمِهِ، (وَإِلَّا) يُولَدْ حَيًّا، بَلْ سَقَطَ مَيِّتًا بِغَيْرِ جِنَايَةٍ؛ (فَ) عَلَى مُشْتَرٍ ضَمَانُ (نَقْصِ وِلَادَةِ) أَمَةٍ (فَقَطْ) ، دُونَ ضَمَانِهِ هُوَ كَنَقْصِ مَغْصُوبَةٍ،
