(وَإِنْ أَسْقَطَهُ) أَيْ الْخِيَارَ (أَحَدُهُمَا) أَيْ الْمُتَبَايِعَانِ؛ بَقِيَ خِيَارُ صَاحِبِهِ، (أَوْ قَالَ) أَحَدُهُمَا (لِصَاحِبِهِ: اخْتَرْ؛ سَقَطَ) خِيَارُ الْقَائِلِ (وَبَقِيَ خِيَارُ صَاحِبِهِ) ؛ لِحَدِيثِ ابْنِ عُمَرَ:«فَإِنْ خَيَّرَ أَحَدُهُمَا صَاحِبَهُ فَتَبَايَعَا عَلَى ذَلِكَ فَقَدْ وَجَبَ الْبَيْعُ» .
