مطالب أولي النهىal-Ruhaybani

(فِي عَقْدِ) بَيْعٍ جُعِلَ (حِيلَةً؛ لِيَرْبَحَ) فِي ثَمَنِ تَرْكِ مَنْزِلِهِ (قَرْضًا) بِسَبَبِ الْخِيَارِ (فَيَحْرُمُ) نَصًّا؛ لِأَنَّهُ يُتَوَصَّلُ بِهِ إلَى قَرْضٍ يَجُرُّ نَفْعًا، (وَلَا يَحِلُّ تَصَرُّفُهُمَا) ؛ أَيْ: الْمُتَعَاقِدَيْنِ فِي ثَمَنٍ وَلَا مُثَمَّنٍ، وَلَا خِيَارَ لَهُمَا.
