وَإلَى صَلَاةٍ بِدُخُولِ وَقْتِهَا، كالْغَدِ بِطُلُوعِ فَجْرِهِ، وَإلىَ طُلُوعِ شَمْسٍ، أَو غُرُوبِهَا، وَيَشُكُّ فِيهِ فَحَتَّى يَتَيَقَّنَ

مطالب أولي النهىal-Ruhaybani

(وَإِلَى صَلَاةٍ) مَكْتُوبَةٍ؛ كَالظُّهْرِ مَثَلًا؛ سَقَطَ (بِدُخُولِ وَقْتِهَا) ؛ كَمَا إذَا شُرِطَ إلَى (الْغَدِ) ؛ فَيَسْقُطُ (بِطُلُوعِ فَجْرِهِ، وَ) إنْ شُرِطَ (بِطُلُوعِ شَمْسٍ، أَوْ إلَى غُرُوبِهَا، وَيَشُكُّ فِيهِ) ؛ أَيْ: الطُّلُوعِ وَالْغُرُوبِ؛ فَيَصِحُّ الشَّرْطُ، وَلَا يَسْقُطُ الْخِيَارُ (حَتَّى يَتَعَيَّنَ) ؛ لِأَنَّ الْأَصْلَ بَقَاؤُهُ، وَإِنْ جُعِلَ الْخِيَارُ
