مطالب أولي النهىal-Ruhaybani

(وَ) يَصِحُّ شَرْطُ الْخِيَارِ لِمُتَعَاقِدَيْنِ - وَلَوْ كَانَا وَكِيلَيْنِ - لِأَنَّ النَّظَرَ فِي تَحْصِيلِ الْحَظِّ مُفَوَّضٌ إلَى الْوَكِيلِ (وَإِنْ لَمْ يُؤْمَرَا) ؛ أَيْ: يَأْمُرْ الْمُوَكِّلَانِ الْوَكِيلَيْنِ (بِهِ) ؛ أَيْ: شَرْطِ الْخِيَارِ؛ لِمَا مَرَّ: أَنَّ شَرْطَ الْحَظِّ مُفَوَّضٌ إلَى الْوَكِيلِ.

وَيَصِحُّ شَرْطُ خِيَارٍ
