مطالب أولي النهىal-Ruhaybani

(وَعَنْهُ) ؛ أَيْ: الْإِمَامِ أَحْمَدَ فِي رِوَايَةِ أَبِي طَالِبٍ: (لَا فَسْخَ لِبَائِعٍ إلَّا بِرَدِّ الثَّمَنِ، وَجَزَمَ بِهِ الشَّيْخُ) تَقِيُّ الدِّينِ؛ (كَالشَّفِيعِ، وَقَالَ الشَّيْخُ: وَكَذَا التَّمَلُّكَاتُ الْقَهْرِيَّةُ؛ كَأَخْذِ غِرَاسٍ، وَبِنَاءِ مُسْتَأْجِرٍ) بَعْدَ انْقِضَاءِ مُدَّةِ الْإِجَارَةِ،
