مطالب أولي النهىal-Ruhaybani

(وَيُقْبَلُ قَوْلُ بَائِعِ) شِقْصٍ (مُعَيَّنٍ) بِيَمِينِهِ (أَنَّهُ) ، أَيْ: الْمَعِيبَ الْمُعَيَّنَ بِعَقْدٍ، (لَيْسَ الْمَرْدُودَ) نَصًّا؛؛ لِأَنَّهُ يُنْكِرُ كَوْنَ هَذِهِ سِلْعَتَهُ، وَيُنْكِرُ اسْتِحْقَاقَ الْفَسْخِ، وَالْقَوْلُ قَوْلُ الْمُنْكِرِ بِيَمِينِهِ،
