وَفِي شَرِكَةٍ: وَهِيَ بَيعُ بَعْضِهِ بِقِسْطِهِ كَأَشْرَكْتُكَ فِي ثُلُثِهِ أو رُبْعِهِ، أو أَشْرَكْتُكَ فَقَطْ، يَنْصَرِفُ لِنِصْفِهِ،

(وَفِي شَرِكَةٍ، وَهِيَ بَيْعُ بَعْضِهِ) ، أَيْ: الْمَبِيعِ (بِقِسْطِهِ) مِنْ الثَّمَنِ، كَقَوْلِهِ: (أَشْرَكْتُكَ فِي ثُلُثِهِ) ، أَوْ أَشْرَكْتُكَ فِي (رُبْعِهِ) ، أَوْ ثُلُثَيْهِ، أَوْ ثُمُنِهِ. (وَأَشْرَكْتُكَ فَقَطْ، يَنْصَرِفُ لِنِصْفِهِ) ؛ لِأَنَّهَا تَقْتَضِي التَّسْوِيَةَ،
