قَالَ الْمُنَقِّحُ: (فَإِنْ نَكَلَا) ، أَيْ: امْتَنَعَ الْبَائِعُ وَالْمُشْتَرِي مِنْ الْحَلِفِ، (صَرَفَهُمَا) حَاكِمٌ، (كَمَا لَوْ نَكَلَ مَنْ تُرَدُّ عَلَيْهِ الْيَمِينُ) عَلَى الْقَوْلِ بِرَدِّهَا، وَهُوَ ضَعِيفٌ.
