مطالب أولي النهىal-Ruhaybani

(وَإِنْ تَعَيَّبْ) مَبِيعٌ عِنْدَ مُشْتَرٍ (قَبْلَ تَلَفِهِ، ضَمَّ أَرْشَهُ إلَيْهِ) إلَى قِيمَتِهِ حَالَ عَقْدٍ، لِاعْتِبَارِهَا حِينَئِذٍ، لَا حِينَ تَلَفٍ. قَالَهُ فِي " الْمُسْتَوْعِبِ "، وَاسْتَظْهَرَهُ فِي " حَاشِيَةِ الْإِقْنَاعِ ". (وَكَذَا كُلُّ غَارِمٍ) يُقْبَلُ قَوْلُهُ فِي قِيمَةِ مَا يَغْرَمُهُ وَقَدْرِهِ وَصِفَتِهِ، كَمُشْتَرٍ،
