مطالب أولي النهىal-Ruhaybani

(وَإِنْ أَحْضَرَ مُشْتَرٍ بَعْضَ الثَّمَنِ، لَمْ يَمْلِكْ أَخْذَ مَا يُقَابِلُهُ) مِنْ مَبِيعٍ (إنْ نَقَصَ) مَبِيعٌ (بِتَشْقِيصٍ) ، كَمِصْرَاعَيْ بَابٍ، وَقُلْنَا: لِبَائِعٍ حَبْسُ مَبِيعٍ عَلَى ثَمَنِهِ لِئَلَّا يَتَصَرَّفَ فِيهِ، وَلَا يَقْدِرَ عَلَى بَاقِي الثَّمَنِ، فَيَتَضَرَّرَ بَائِعٌ بِنَقْصِ قِيمَةِ مَا بِيَدِهِ.
