(فِيمَا قَبْضُهُ شَرْطٌ لِصِحَّتِهِ، كَصَرْفٍ وَ) رَأْسِ مَالِ (سَلَمٍ، وَرِبَوِيٍّ) بِرِبَوِيٍّ؛ لِأَنَّ مِلْكَهُ عَلَيْهِ غَيْرُ تَامٍّ، أَشْبَهَ التَّصَرُّفَ فِي مِلْكِ الْغَيْرِ.
