(وَالْفَسْخُ) بِالْإِقَالَةِ أَوْ غَيْرِهَا (رَفْعُ عَقْدٍ مِنْ حِينِ فَسْخٍ) ، لَا مِنْ أَصْلِهِ، كَالْخُلْعِ وَالطَّلَاقِ. هَذَا الْمَذْهَبُ، (فَمَا حَصَلَ مِنْ) كَسْبٍ و (نَمَاءٍ مُنْفَصِلٍ، فَلِمُشْتَرٍ) ، لِحَدِيثِ:«الْخَرَاجُ بِالضَّمَانِ» ) .
