وَنَحْو نَخْلٍ عَلَيهِ ثَمَرْ بِمِثْلِهِ وَبِتَمْرٍ، وَثَمَرَةُ كُلٍّ لِبَائِعِهِ.

مطالب أولي النهىal-Ruhaybani

(وَ) بَيْعُ (نَخْلٍ عَلَيْهِ تَمْرٌ) أَوْ رُطَبٌ (بِمِثْلِهِ) ، أَيْ: بِنَخْلٍ عَلَيْهِ تَمْرٌ أَوْ رُطَبٌ، (وَ) بَيْعُ نَخْلٍ عَلَيْهِ تَمْرٌ (بِتَمْرٍ) ، أَوْ رُطَبٍ؛ لِأَنَّ الرِّبَوِيَّ فِي ذَلِكَ غَيْرُ مَقْصُودٍ بِالْبَيْعِ، فَوُجُودُهُ كَعَدَمِهِ، (وَثَمَرَةُ كُلٍّ) مِنْ نَخْلٍ عَلَيْهِ تَمْرٌ (لِبَائِعِهِ) .
