مطالب أولي النهىal-Ruhaybani

(وَإِنْ تَأَخَّرَ) تَقَابُضٌ فِي صَرْفٍ، أَوْ فِي رَأْسِ مَالِ سَلَمٍ (فِي بَعْضٍ) مِنْ ذَلِكَ، (بَطَلَ) ، أَيْ: الصَّرْفُ وَالسَّلَمُ (فِيهِ) ، أَيْ: الْمُتَأَخِّرِ قَبْضُهُ (فَقَطْ) ، لِفَوَاتِ شَرْطِهِ، وَصَحَّا فِيمَا قَبَضَ، لِوُجُودِ شَرْطِهِ، وَيَقُومُ الِاعْتِيَاضُ مِنْ أَحَدِ الْعِوَضَيْنِ، وَسُقُوطُهُ عَنْ ذِمَّةِ أَحَدِهِمَا مَقَامَ قَبْضِهِ.
