مطالب أولي النهىal-Ruhaybani

(وَإِنْ شَرَطَ) مُقْرِضٌ (رَدَّهُ) ؛ أَيْ: الْقَرْضِ (بِعَيْنِهِ؛ لَمْ يَصِحَّ) الشَّرْطُ؛ لِأَنَّهُ يُنَافِي مُقْتَضَى الْعَقْدِ، وَهُوَ التَّوَسُّعُ بِالتَّصَرُّفِ، وَرَدُّهُ بِعَيْنِهِ يَمْنَعُ مِنْ ذَلِكَ.
