وَيَنعَقِدُ بِلَفظٍ وَمُعَاطَاةٍ،

(وَيَنْعَقِدُ) الرَّهْنُ (بِلَفْظٍ) . قَالَ فِي " الْإِنْصَافِ " وَالْإِقْنَاعِ " وَغَيْرِهِمَا: وَلَا يَصِحُّ الرَّهْنُ بِدُونِ إيجَابٍ وَقَبُولٍ وَمَا يَدُلُّ عَلَيْهِمَا مِنْ الرَّاهِنِ وَالْمُرْتَهِنِ؛ كَسَائِرِ الْعُقُودِ. (وَ) يَنْعَقِدُ (بِمُعَاطَاةٍ) ؛ كَالْبَيْعِ، قَالَهُ فِي الرِّعَايَةِ ".
