(وَيَتَّجِهُ) لَا تَصِحُّ زِيَادَةُ دَيْنِ الرَّهْنِ (إلَّا بِعَقْدٍ مُتَجَدِّدٍ) ؛ كَأَنْ يَفْسَخَ الْمُرْتَهِنُ الرَّهْنَ، ثُمَّ يُجَدِّدَ مَعَ الرَّاهِنِ عَقْدًا عَلَى الدَّيْنَيْنِ بِذَلِكَ الرَّهْنِ. وَهُوَ مُتَّجِهٌ
