وَيُقْبَلُ قَوْلُ رَاهِنٍ فِي قدرِ حَادِثٍ.

مطالب أولي النهىal-Ruhaybani

(وَ) إنْ اخْتَلَفَا وَتَشَاحَّا؛ (فَيُقْبَلُ قَوْلُ رَاهِنٍ) بِيَمِينِهِ (فِي قَدْرِ حَادِثٍ) ؛ لِأَنَّهُ مُنْكِرٌ.

[فَصَلِّ شَرْطُ تَنْجِيزِ الرَّهْن] (فَصْلٌ) : لَمَّا كَانَتْ صِحَّةُ الرَّهْنِ تَفْتَقِرُ إلَى شُرُوطٍ سِتَّةٍ اُحْتِيجَ إلَى التَّنْبِيهِ عَلَيْهَا.
