(وَإِنْ تَصَرَّفَ) الرَّاهِنُ (فِيهِ) ؛ أَيْ: الرَّهْنِ (بِمَا يَنْقُلُ الْمِلْكَ؛ كَهِبَةٍ وَصَدَاقٍ بِإِذْنِ مُرْتَهِنٍ؛ صَحَّ) تَصَرُّفُهُ، (وَبَطَلَ الرَّهْنُ) لِأَنَّ هَذَا التَّصَرُّفَ يَمْنَعُ الرَّهْنَ ابْتِدَاءً، فَامْتَنَعَ مَعَهُ دَوَامًا
