وَإِنْ لَمْ تَحْبَلْ؛ فَأَرْشُ بِكْرٍ كَجِنَايَةٍ،

(وَإِنْ) وَطِئَ رَاهِنٌ مَرْهُونَةً بِغَيْرِ إذْنِ مُرْتَهِنٍ، (وَلَمْ تَحْبَلْ؛ فَعَلَيْهِ أَرْشُ بِكْرٍ) فَقَطْ يُجْعَلُ رَهْنًا مَعَهَا؛ (كَجِنَايَةٍ) عَلَيْهَا،
