(لَكِنْ يَصِيرُ) الرَّهْنُ (مَضْمُونًا) عَلَى الْمُرْتَهِنِ (بَعْدَ الْحُلُولِ؛ لِأَنَّهُ بَيْعٌ فَاسِدٌ؛ كَمُؤَقَّتٍ فَرَغَتْ مُدَّتُهُ) ، فَلَا أَقَلَّ مِنْ أَنْ يَصِيرَ؛ كَالْعَارِيَّةِ، وَهِيَ مَضْمُونَةٌ. وَيَأْتِي: إذَا شَرَطَ فِي الرَّهْنِ مَا لَا يَقْتَضِيهِ الْعَقْدُ.
