(وَلَا يُنْقَلُ) رَهْنٌ (عَنْ يَدٍ مِنْ شَرْطِ) كَوْنِهِ بِيَدِهِ (مَعَ بَقَاءِ حَالِهِ) ؛ أَيْ أَمَانَتِهِ (إلَّا بِاتِّفَاقِ رَاهِنٍ وَمُرْتَهِنٍ) لِأَنَّ الْحَقَّ لَا يَعْدُوهُمَا؛
