(وَيَتَّجِهُ بِاحْتِمَالٍ) قَوِيٍّ (وَلَا يَضْمَنُ) الْمُرْتَهِنُ تَلَفَ دَابَّةٍ مَرْهُونَةٍ رَكِبَهَا بِنَفَقَتِهَا إذَا لَمْ يُنْهِكْهَا بِذَلِكَ؛ لِأَنَّهُ مَأْذُونٌ فِيهِ شَرْعًا. وَهُوَ مُتَّجِهٌ.
