وَإِنْ جَنَى بِإِذْنِ سَيِّدِهِ وَيَعْلَمُ التَّحْرِيمَ وَأَنَّهُ لَا يَلْزَمُهُ قَبُولُ ذَلِكَ مِنْ سَيِّدِهِ فَكَالْجِنَايَةِ بِلَا إذْنِهِ،

مطالب أولي النهىal-Ruhaybani

(وَإِنْ جَنَى) الْمَرْهُونُ (بِإِذْنِ سَيِّدِهِ وَ) كَانَ (يَعْلَمُ التَّحْرِيمَ) ؛ أَيْ: تَحْرِيمَ الْجِنَايَةِ، (وَ) يَعْلَمُ (أَنَّهُ لَا يَلْزَمُهُ قَبُولُ ذَلِكَ) الْأَمْرِ مِنْ سَيِّدِهِ؛ (فَكَالْجِنَايَةِ بِلَا إذْنِهِ) مِنْ أَنَّهَا تَتَعَلَّقُ بِرَقَبَتِهِ، وَتَقَدَّمَ مُفَصَّلًا.
