(وَإِنْ بَاعَهُ) ؛ أَيْ: الرَّهْنَ (حَاكِمٌ، وَوَفَّاهُ) حَقَّهُ مِنْ ثَمَنِهِ؛ (جَازَ) ؛ لِأَنَّ الْحَاكِمَ لَهُ [وِلَايَةُ] مَالِ الْغَائِبِ، (وَيَأْتِي فِي) بَابِ (الْغَصْبِ تَتِمَّتُهُ)
