مطالب أولي النهىal-Ruhaybani

(وَ) قَوْلُ رَبِّ دَيْنٍ لِضَامِنٍ: (وَهَبْتُكَهُ) ؛ أَيْ: الدَّيْنَ (تَمْلِيكٌ لَهُ) ؛ أَيْ: لِلضَّامِنِ، (فَيَرْجِعُ الضَّامِنُ بِالدَّيْنِ الْمَوْهُوبِ لَهُ عَلَى مَضْمُونٍ) عَنْهُ؛ كَمَا لَوْ دَفَعَهُ عَنْهُ، ثُمَّ وَهَبَهُ إيَّاهُ، وَيُؤْخَذُ مِنْهُ صِحَّةُ هِبَةِ الدَّيْنِ لِمَنْ هُوَ عَلَيْهِ وَلَوْ ضَامِنًا.
