مطالب أولي النهىal-Ruhaybani

[فَرْعٌ قَالَ لِآخَرَ اضْمَنْ فُلَانًا فَفَعَلَ] (فَرْعٌ: لَوْ قَالَ)

شَخْصٌ لِآخَرَ: (اضْمَنْ) فُلَانًا (أَوْ) قَالَ: (اُكْفُلْ فُلَانًا) ، أَوْ اضْمَنْ عَنْ فُلَانٍ، أَوْ اُكْفُلْ عَنْهُ، (فَفَعَلَ؛ لَزِمَ) الضَّمَانُ أَوْ الْكَفَالَةُ (الْمُبَاشِرَ، لَا الْآمِرَ) ؛ لِأَنَّهُ كَفِيلٌ بِاخْتِيَارِ نَفْسِهِ، وَإِنَّمَا الْآمِرُ لِلْإِرْشَادِ، فَلَا يَلْزَمُ بِهِ شَيْءٌ
