(وَإِنْ رَجَعَ بِشَيْءٍ اشْتَبَهَ بِغَيْرِهِ) ؛ بِأَنْ رَجَعَ فِي عَبْدٍ مَثَلًا وَلَهُ عَبِيدٌ، وَاخْتَلَفَ الْمُفْلِسُ وَرَبُّهُ فِيهِ؛ (قُدِّمَ تَعْيِينُ مُفْلِسٍ) ؛ لِأَنَّهُ يُنْكِرُ دَعْوَى اسْتِحْقَاقِ الرَّاجِعِ؛ وَالْأَصْلُ مَعَهُ.
