(وَيَتَّجِهُ بِاحْتِمَالٍ) قَوِيٍّ (أَوْ) مَا لَمْ يَكُنْ الْمَسْكَنُ وَالْخَادِمُ (رَهْنًا) ،

فَإِنْ كَانَ رَهْنًا فَلِلْمُرْتَهِنِ اسْتِيفَاءُ دَيْنِهِ مِنْ ثَمَنِهِ؛ لِتَعَلُّقِ حَقِّ الْمُرْتَهِنِ، فَهُوَ أَقْوَى سَبَبًا مِنْ الْمُفْلِسِ.

وَهُوَ مُتَّجِهٌ.
