وَلَا يَمْلِكُ أَجْنَبِيٌّ وَفَاءِ دَينِهِ مُتَبَرِّعًا بِلَا رِضَاهُ وَلَا يَمْلِكُ الْحَاكِمُ قَبْضَ ذَلِكَ بِلَا إذْنِهِ،

مطالب أولي النهىal-Ruhaybani

(وَلَا يَمْلِكُ أَجْنَبِيٌّ وَفَاءَ دَيْنِهِ) ؛ أَيْ: الْمَدِينِ (مُتَبَرِّعًا) بِذَلِكَ (بِلَا رِضَاهُ) ؛ أَيْ: الْمَدِينِ، (وَلَا يَمْلِكُ الْحَاكِمُ قَبْضَ ذَلِكَ) ؛ أَيْ: مَا ذُكِرَ مِنْ هِبَةٍ وَصَدَقَةٍ وَنَحْوِهَا لِلْمَدِينِ لِوَفَاءِ دَيْنِهِ (بِلَا إذْنِهِ) ؛ أَيْ: الْمَدِينِ، لِأَنَّهُ لَا يَمْلِكُ إجْبَارَهُ عَلَيْهِ؛ فَلَمْ يَمْلِكْ فِعْلَهُ عَنْهُ.
