مطالب أولي النهىal-Ruhaybani

(فَلَا يَصِحُّ) تَزْوِيجُ السَّفِيهِ (لِغَيْرِهَا) ؛ أَيْ: الْحَاجَةُ (بِلَا إذْنِهِ) ؛ أَيْ: الْوَلِيِّ؛ لِأَنَّهُ تَصَرُّفٌ يَجِبُ بِهِ مَالٌ؛ فَلَمْ يَصِحَّ بِغَيْرِ إذْنِ وَلِيِّهِ؛ كَالشِّرَاءِ، (وَمَعَهَا) ؛ أَيْ: الْحَاجَةُ (يَتَعَقَّلُ) السَّفِيهُ (بِهِ) ؛ أَيْ: التَّزَوُّجِ كَمَا تَقَدَّمَ.
