(لِوَلِيٍّ لَهُ) حُرٌّ (مُمَيِّزٌ) ذَكَرًا كَانَ أَوْ أُنْثَى، (وَلِسَيِّدِهِ) ؛ أَيْ: الْقِنِّ الْمُمَيِّزِ أَوْ الْبَالِغِ (أَنْ يَأْذَنَ لَهُ) ؛ أَيْ: لِمُوَلِّيهِ أَوْ قِنِّهِ (أَنْ يَتَّجِرَ) لِقَوْلِهِ تَعَالَى: {وَابْتَلُوا الْيَتَامَى} وَلِأَنَّهُ عَاقِلٌ مَحْجُورٌ عَلَيْهِ؛ فَصَحَّ تَصَرُّفُهُ بِإِذْنِ وَلِيِّهِ وَسَيِّدِهِ؛ كَالْعَبْدِ الْكَبِيرِ وَالسَّفِيهِ.
